How the Social Insurance Fund reduces the amounts for offset and reimbursement

An employer cannot always count on reimbursement of benefits from the Social Insurance Fund. The Fund often does not recognize amounts paid as benefits. Most of the litigation concerns controversial (in the opinion of the fund) child benefits. Let’s talk about them using examples from judicial practice.

Example 1

The company paid child care benefits to grandmothers who worked part-time. At the same time, grandmothers lived separately from their children, and mothers did not work and, in fact, they were the ones who looked after their children.

The FSS did not recognize the amounts paid as benefits, but the court supported it (resolution of the Arbitration Court of the Central District dated August 26, 2021 No. F10-2645/2021 in case No. A54-5101/2021).

Example 2

The employer paid care benefits to the child’s father. The employee worked part-time. At the same time, the child’s mother did not work anywhere during this period.

The FSS and the judges concluded that the reduction in time by 1 hour did not allow the child’s father to fully provide care. As a result, the amounts paid are not benefits, but are recognized as additional remuneration at the expense of the employer (resolution of the Arbitration Court of the Ural District dated 06.06.2021 in case No. A76-29523/2021).

Example 3

The subject of a dispute between the Social Insurance Fund and the employer was the child care benefit, which was paid to a mother working on a short-time basis. However, this time the court supported the employer (resolution of the Arbitration Court of the Ural District dated 07/05/2021 No. F09-3862/19 in case No. A76-39929/2021).

The following circumstances served as arguments for the judges: the recipient of the benefit was a single mother, and there was no evidence that anyone else (other than herself) was looking after the child. The actual time worked during the period of receiving benefits was 69%, loss of earnings was 14%.

Example 4

An employee who receives child care benefits and works under shortened working hours was sent on a business trip for 4 days. The FSS considered that during the business trip the woman could not care for the child, that is, she lost the right to benefits.

However, judges of all instances, including the Supreme Court of the Russian Federation, did not agree with this approach. In their opinion, in such circumstances (during a short-term business trip) it cannot be considered that parental care has been terminated. We can talk about a lack of care when a business trip lasts more than a month (definition of the RF Armed Forces dated 08/02/2021 No. 309-ES19-12197).

From the examples given, we can conclude that the payment of benefits for child care in conditions where the recipient works part-time almost always causes complaints from controllers from the Social Insurance Fund. In court, employers manage to fight off some of the claims due to the fact that the circumstances of each case are considered separately, taking into account all the nuances.

In order to receive reimbursement from the Social Insurance Fund in 2021 for expenses incurred in 2020, the employer must submit to the fund a written application, a calculation certificate, a breakdown of expenses and additional documents depending on the type of benefit or payment.

Since 2021, the “Direct Payments” project has been implemented throughout the Russian Federation. Employers no longer pay most benefits. All benefits to the insured persons are paid directly by the fund based on the documents submitted by the policyholder.

What thread should I use to stitch documents?

  • If you don’t take the filing of documentation seriously, then the papers prepared for delivery may simply be returned to you with the requirement to completely redo the firmware. What thread to stitch documents with
  • The documentation is sewn together with bank twine, thin Mylar tape or stitching threads. But if there are no such threads, then ordinary harsh threads will do.
  • 2-3 sheets are sewn together with regular thread. It needs to be folded in half for strength. The stitching process begins with holes being made in the sheets. The stitching is done from the back side of the sheets assembled together.
  • The needle is inserted into the middle hole first. It is better to use dual firmware. When the stitching is completed, the needle and thread are inserted into the central hole and brought out to the back of the assembled documents. The remaining end of the thread must be tied in a knot.

Stage 1:

  • We arrange the papers as they should be located in the document. We number each page with numbers in the upper right corner. For this we use a simple pencil.
  • Making punctures. If our document is made up of several sheets, then a puncture can be easily made with a needle and thread. We pierce a multi-page document with an awl or use a sharp nail. To facilitate the process of piercing the paper, take a hammer.
  • How many holes should I make? This depends on the requirements of the organization that is requesting the documents. The punctures should be evenly spaced along the left margin. Holes are made in the middle of the sheet, the distance between them is 3 cm.

The document certifier signs. If there is a stamp or it is necessary on the document, then we put a stamp.
